Welcome to Heart of Song. By accessing our website or purchasing our services, you agree to be bound by these Terms of Service. Please read them carefully.
1. Services
Heart of Song provides custom personalized song creation services ("Services"). We create original songs based on information and preferences you provide through our quiz and ordering process.
2. Orders and Payment
By placing an order, you agree to pay the stated price for the Services. All prices are in US dollars. Payment is processed securely through Stripe at the time of purchase. Your order is confirmed upon successful payment. Optional add-ons such as priority delivery upgrades are clearly stated at checkout and are entirely optional.
3. Delivery
Standard orders are delivered to your email address within 3 business days of your order confirmation. Priority delivery orders are delivered within 24 hours. Delivery times are estimates and may vary based on order volume. Your completed song will be delivered digitally to the email address provided at checkout.
4. Refund Policy
Due to the custom and personalized nature of our Services, all sales are final once song creation has begun. If you are unsatisfied with your song, please contact us at help@heartofsong.com within 7 days of delivery and we will work with you to make reasonable revisions. Refunds may be issued at our sole discretion in cases where we are unable to deliver the service as described.
5. Intellectual Property
Upon full payment, you are granted a personal, non-commercial license to use, share, and enjoy your custom song. Heart of Song retains all underlying intellectual property rights in the music composition and production. You may not resell, redistribute commercially, or claim authorship of the song without our written permission.
6. User Responsibilities
By using our Services you agree to:
- Provide accurate and truthful information in your quiz responses
- Not submit content that is unlawful, defamatory, or infringes on third-party rights
- Not use our Services for any illegal or unauthorized purpose
We reserve the right to refuse service to anyone for any reason.
7. Limitation of Liability
To the fullest extent permitted by law, Heart of Song shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.
8. Disclaimer of Warranties
Our Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our Services will meet every expectation, though we strive to deliver high-quality personalized songs.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
10. Changes to Terms
We reserve the right to update these Terms of Service at any time. Continued use of our Services after changes are posted constitutes acceptance of the revised terms.
